Appeal Court Upholds Election Of Adeleke In Osun Governorship Poll
The court of appeal, Ibadan, has upheld the election of governor Ademola Adeleke in the Osun state’s July 16,2022 governorship poll.
The three appelate court set aside the January 22, 2023 judgement of the Osun state governorship poll petition tribunal, which ordered the governor to vacate office for his predecessor, Gboyega Oyetola.
Justice Mohammed Shuaib, who read the unanimous judgement dismissed the judgement while ruling on an appeal filed by governor Adeleke against the verdict of the tribunal.
The panel ruled that Oyetola and his party, the APC, failed to prove the claim of overvoting in the polls, and was relying on the weakness of adeleke and the PDP over its claim that the conduct of the poll violated the electoral act 2022.
Also awarded N500,000 cost against governor Gboyega Oyetola.
INEC said adeleke polled 403,371 votes to defeat then-incumbent governor Adegboyega Oyetola of the APC, who got 375,027 votes.
But Oyetola and the APC rejected the result of the poll and headed for the tribunal.
In its January 27, 2023 majority verdict, the justice Tertse Kume-led tribunal annulled Adeleke’s victory and declared Oyetola the winner of the poll.
